Safety Reps and Safety Committees Regulations 1977 Give USRs legal rights employers cannot ignore

 

Union Safety Reps and Trade Union Brnaches often forget that the role and responsibiites of a USR, is enshrigned in law; and employers cannot break that law in the same way they cannot break all Health & Safety legislation. It is an imperetive for all USRs to be fully knowledgable of the regulations and to have easy access to the regulations.

 

Union Branches in particular need to ensure their safety reps have access to a copy of the regulations, and when time off work for safety reps to implement their duties and rights is arranged, the employer and Trade Union Branches need to ensure their release is not impeded and curtailed; or their rights transferred to other officials who are not health and safety reps.

 

Nor can the employer determine who the Union's safety reps are!

 

The SRSC Regs should be quoted to employers whenever necessary to protect the rights of USRs, including the right to make quarterly safety checks of the workplaces of the employer and union members they represent, assign safety reps independently from employers, to be advised of any incident which injures or could injure an employee, and to be allwed to immeditaely investigate the incident and record the details of the incident incluing using photography, witness statements, victim statements and issue reports and recomendations to management in order to help the employer to take remidial action to ensure safer working systems and equipment are put in place; and to ensure the incident does not occur again. This is part of the Employers duty of care to all its employees.

 

The CWU has a proud history of Health & Safety Education as does the TUC, to which the Union is affiliated.

 

The TUC has produced an updated version of what is commonly called 'The Brown Book' aka Safety Reps and Safety Committees Regulations 1977 which came into force in 1978. Indeed, the editor of this website became one of the first USRs in the North West that year, when the Union was then known as the CPSA P&T Group.
